Has anyone ever not lost their license for high range DUI in Australia? Know any good lawyers for this in QLD?
I have a dui of 0.151. just into the high range level. I am very sorry for what I have done, but am suffering terribly from depression, anxiety etc now because of the possible loss of license. Most people have told me its just not possible to get a restricted/special license. If I got a lawyer would this help me? Does it make a difference why the police pulled you over, and their reasons?
Please if anyone can help me, I would do anything to keep my license, eg community service, volunteering etc.
No – your licence is probably already suspended, you will be disqualified, and it will be VERY difficult for you to obtain a restricted licence.
By s.79(1) of the TORUM (see http://www.legislation.qld.gov.au/LEGISLTN/CURRENT/T/TrantOpRUA95.pdf) you are liable for a fine of up to $2100 or 9 mths jail, and by s.86 you will be disqualified for 6 mths.
By s.79B your licence is immediately suspended from the time you are charged until you are dealt with by the courts.
A s.79E order may be made allowing you to drive while suspended, subject to certain restrictions but to get this you have to follow all the procedures in Part 6B of the TORUM’s Regulations (at http://www.legislation.qld.gov.au/LEGISLTN/CURRENT/T/TrantOpRUDLR99.pdf) – notice you must apply within 21 days.
When you finally get to court, you can apply under s.87 for a restricted licence but you will have very little hope of satisfying all the requirements.
